When the state Energy and Environment Cabinet or Louisville Air Pollution Control District takes enforcement action for a violation of Clean Air Laws or regulations, they can use "any credible evidence" to prove there is a violation.  When a citizen observes fugitive dust emissions crossing property lines, or takes a sample, that evidence if credible should be considered. Witness testimony is specifically allowed under the Clean Air Act, to establish violations.
 
Yet HB 137 would prohibit the use of most citizen-gathered evidence, videos, photographs, or other documentation; and would violate the state and local agency obligations to consider and use "any credible evidence" in holding polluters accountable.
