On January 22, 2021, the Sierra Club released a press release on Citizens Coal Council, Appalachian Voices, and the Sierra Club, filing suit in the United States District Court for the District of Columbia challenging the Office of Surface Mining, Reclamation, and Enforcement's final Ten-Day Notice Rule.

The suit is being represented by the Kentucky Resources Council's Director, Tom FitzGerald.
KRC previously posted about this Ten-Day Notice Rule. In June 2020, we partnered with many organizations, together representing thousands of individuals who live, work, and recreate near surface coal mining operations that are regulated under the Surface Mining Control and Reclamation act of 1977 (SMCRA).
