Among the categories of solid waste landfills allowed in Kentucky are "construction or demolition debris landfills" (CDD Landfills), which are permitted solely to accept waste from the construction, repair, and demolition of structures and roads, and vegetation from land clearing and grubbing. State regulations have for many years allowed CDD landfills of less than one acre in size to be approved without liners or leachate collection systems, designed to protect against groundwater pollution. A 2024 state law change allows a doubling of the size of these CDD landfills. KRC, in comments submitted opposing the regulatory amendments intended to accommodate this new law, has challenged the legal and technical basis for the Cabinet's allowance of these less-than-one acre (and potentially two-acre) CDD landfills without requiring the same liner, leachate collection, groundwater monitoring, and other protections required of larger CDD landfills.
